First Prop 8, Now DOMA: One day after hearing a challenge to California’s same-sex marriage ban, the U.S. Supreme Court will hear arguments in a case challenging the constitutionality of the Defense of Marriage Act—DOMA— the federal law defining marriage as the union of a man and a woman. At yesterday’s hearing, six justices suggested the timing of the case challenging Prop 8 may be wrong, and suggested they may vote to dismiss it.
